OUG 32/2026: the WorkinRomania platform and the firm-offer rule

What the new law changes for employers bringing in foreign workers: the WorkinRomania platform, a firm job offer before the file is submitted, and which agencies are authorised to act as intermediary.

OUG 32/2026 replaced the aviz de angajare — the abolished employment permit — with a single application filed on the state's electronic platform, and tied it to a firm, verifiable offer: the job, the salary and the conditions have to be real before the file reaches the authorities, not negotiated afterwards.

The WorkinRomania platform becomes the central point where both the offers and the agencies authorised to intermediate recruitment are registered. An agency that does not appear on the platform cannot file applications on an employer's behalf.

There is one further condition, just as important: the procedure can be initiated only if the occupation appears on the List of Shortage Occupations (Lista ocupațiilor deficitare), approved by order of the minister of labour and published in Monitorul Oficial.

For the employers we work with, this means an extra verification step at the start of the process, but also a protection: the file that is submitted matches exactly the offer the candidate accepted.
